PCB Heaven Terms of service


ACCEPTANCE
By using the Products and Services, you are agreeing, without limitation or qualification, to be bound by, and to comply with, these Terms of Service and any other supplemental terms and conditions, posted guidelines or rules applicable to PCBheaven web site, Product or Service. All such guidelines and rules are hereby incorporated by reference into the Terms of Service.

You may not use the Services and may not accept the Terms if (a) you are not of legal age to form a binding contract with PCBheaven, or (b) you are a person barred from receiving the Services under the laws of the United States, European union or other countries including the country in which you are resident or from which you use the Services.

You acknowledge and agree that PCBheaven may terminate your access to the site or to any of the Products and Services should you fail to comply with the Terms of Service or any other guidelines and rules published by PCBheaven. Any such termination shall be in PCBheaven's sole discretion and may occur without prior notice, or any notice. PCBheaven further reserves the right to terminate any user's access to the PCBheaven site or to any of the Products and Services for any conduct that PCBheaven, in its sole discretion, believes is or may be directly or indirectly harmful to other users, to PCBheaven or to other third parties, or for any conduct that violates any local, state, federal, or foreign laws or regulations. PCBheaven further reserves the right to terminate any user's access to the PCBheaven site or to any of the Products and Services for any reason or for no reason at all, in PCBheaven's sole discretion, without prior notice, or any notice.

You may use the Services on the Site for your personal, non-commercial use. You may make a single copy of the individual screens you see when you use the Services, but only for your personal use. You cannot distribute or transfer the copies to others in exchange for money or other consideration. You may not modify, reformat, copy, display, distribute, transmit, publish, license, create derivative works from, transfer or sell any information, products or services obtained from the Services, except as set forth below. This means that you may not mirror the home page or results pages of the Site or PCBheaven Site on your own web site or web page.

CONDUCT OF VISITORS
We believe that all visitors benefit from basic rules regarding conduct while using the Services so that everyone feels free to share opinions and ideas. The free flow of ideas is jeopardized when a few individuals act irresponsibly. 9. You will not use the Services to harm minors in any way, or encourage interactions with minors of a sexual nature;
10. You will not manipulate the Services so as to hide your identity or participation in Services on the Site (by using another person's identity, changing headers, or otherwise modifying any other possible identifier);
11. You will not send any bulk unsolicited advertising, promotional information, e-mail or other solicitation (including, without limitation, junk mail, spam, chain letters or pyramid schemes of any sort) to any person through the use of the Services.

You will not retrieve any data or other content from this site (systematically or otherwise) to create or compile, directly or indirectly, a collection, compilation, database, directory or any other record of the data and/or content without PCBheaven's express written permission. Because PCBheaven has no control over such sites and resources, you acknowledge and agree that PCBheaven is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that PCBheaven shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

INDEMNITY
You agree to indemnify and hold PCBheaven and its subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

CERTAIN CONDITIONS MAY INDUCE PREVIOUSLY UNDETECTED EPILEPTIC SYMPTOMS EVEN IN USERS WHO HAVE NO HISTORY OF PRIOR SEIZURES OR EPILEPSY. IF YOU, OR ANYONE IN YOUR FAMILY, HAVE AN EPILEPTIC CONDITION, CONSULT YOUR PHYSICIAN PRIOR TO USING THE SERVICE. SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, AND PUNITIVE DAMAGES (EVEN IF PCBheaven OR ITS LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES).
